Terms of Service

These Terms of Service constitute a legally binding agreement between you and Bluprintr, Inc., a Delaware corporation ("Company," "we," "us," or "our"), governing your access to and use of the Huon mobile and desktop application (the "App" or "Service"). By using the App, you agree to be bound by these terms.

1. Acceptance of Terms

By downloading, installing, or using Huon ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

2. Developer Information

Huon is developed and maintained by Bluprintr, Inc., a Delaware corporation ("Company," "we," "us," or "our"). For questions or concerns, please contact us at legal@huon.app.

3. License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App for your personal, non-commercial purposes on devices that you own or control.

4. Restrictions

You agree not to:

  • Modify, reverse engineer, decompile, or disassemble the App
  • Remove or alter any copyright, trademark, or other proprietary notices
  • Use the App for any unlawful purpose or in violation of these Terms
  • Attempt to gain unauthorized access to any portion of the App or its related systems
  • Redistribute, sell, rent, lease, or sublicense the App
  • Use the App in any manner that could damage, disable, or impair the App or interfere with others' use

5. Third-Party Content and Services

The App allows you to import and use your own content, including Anki packages. You are solely responsible for any content you import or create within the App. The App integrates with third-party AI services (OpenAI, Anthropic) which are subject to their respective terms of service and privacy policies.

Anki is a trademark of Ankitects Pty Ltd. Huon is not affiliated with, endorsed by, or sponsored by Ankitects Pty Ltd.

6. Authentication and Account Requirements

Use of AI features and certain App functionality requires authentication through Auth0. By creating an account, you agree to:

  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized access to your account
  • Accept responsibility for all activities that occur under your account
  • Comply with Auth0's terms of service available at https://auth0.com/legal

7. Beta Testing Period and Service Availability

IMPORTANT: The App and its AI features are currently in a beta pre-release testing phase. By using the App during this period, you acknowledge and agree to the following:

7.1 Beta Status and Breaking Changes

During the beta testing period:

  • The App and AI features are provided for testing and feedback purposes
  • Breaking changes are expected to occur without prior notice
  • Features may be added, modified, or removed at any time
  • Service interruptions, bugs, and errors are likely
  • Data formats, APIs, and functionality may change incompatibly
  • We make no guarantees about service stability or continuity

You use beta features at your own risk and should not rely on them for critical purposes.

7.2 Pricing Subject to Change

Current pricing and service terms during beta:

  • Current Status: AI features are currently offered at no cost during the beta testing period
  • Subject to Change: Pricing, subscription tiers, and rate limits are subject to change at any time without advance notice
  • Future Pricing: We reserve the right to introduce fees, modify free tier limits, or change subscription pricing at our sole discretion
  • Grandfathering Not Guaranteed: Beta testers are not guaranteed any special pricing or features when the service exits beta
  • Notice of Changes: While we will attempt to provide reasonable notice of pricing changes, we are not obligated to do so during the beta period

By continuing to use the service after any pricing changes, you agree to the new pricing terms.

7.3 Reasonable Usage and Fair Use

While AI features are currently free during beta, you agree to:

  • Reasonable Usage: Use AI features for legitimate personal study and learning purposes only
  • No Abuse: Not abuse, exploit, or attempt to manipulate the service or rate limits
  • No Automated Access: Not use bots, scripts, or automated tools to access AI features without prior written permission
  • No Resale: Not resell, redistribute, or commercially exploit AI features
  • No System Interference: Not attempt to interfere with, disrupt, or gain unauthorized access to the service

We reserve the right to define and enforce "reasonable usage" at our sole discretion based on service capacity and fair use principles.

7.4 Account Termination for Abuse

During the beta testing period, we reserve the right to:

  • Immediately terminate or suspend accounts that engage in abuse or excessive usage
  • Modify or reduce rate limits for individual users without notice
  • Block access to AI features temporarily or permanently
  • Terminate accounts that violate these Terms or applicable laws
  • Remove or delete content that violates our policies

Examples of abuse include but are not limited to:

  • Exceeding rate limits through multiple accounts or automated access
  • Generating inappropriate, illegal, or harmful content
  • Attempting to reverse engineer, exploit vulnerabilities, or bypass security measures
  • Using the service to train competing AI models or services
  • Creating accounts with false information or impersonating others
  • Excessive usage that degrades service performance for other users

Account termination decisions are final and at our sole discretion. We are not obligated to provide warnings before termination, though we may choose to do so.

7.5 Beta Testing Indemnification

You acknowledge and agree that:

  • We are not liable for any disruptions, data loss, or service changes during the beta period
  • Breaking changes may render your data, workflows, or integrations incompatible
  • We make no commitments to maintain backward compatibility
  • You are responsible for maintaining backups of your data
  • Beta testing is provided "as-is" with no warranty of fitness for any particular purpose
  • We may discontinue the beta program or the App entirely at any time

7.6 Feedback and Testing Data

By participating in the beta program:

  • We may collect usage data, error logs, and performance metrics for testing purposes
  • Any feedback, suggestions, or bug reports you provide become our property
  • We may use feedback to improve the service without compensation to you
  • You grant us the right to use anonymized usage data for service improvement

8. AI Features and Managed Service

The App provides AI-powered features for flashcard generation, content analysis, and study assistance through our managed infrastructure. By using AI features, you acknowledge and agree to the following:

8.1 Service Description

AI features include:

  • Field role/styling aware flashcard creation with iteration and refinement
  • Content generation from user-entered text, PDF uploads, web links, and web searches
  • Complex card generation supporting multiple input sources
  • AI-powered explanations, tutoring, and study assistance

These features are provided through our Cloudflare AI Gateway infrastructure, which routes requests to OpenAI and Anthropic services.

7.2 Authentication Requirement

AI features require:

  • A valid Auth0 account
  • Active authentication session
  • Compliance with subscription tier limits

7.3 Subscription Tiers and Rate Limiting

AI features are subject to usage limits based on your subscription tier:

  • Free Tier: Limited number of AI requests per day
  • Paid Tier: Higher quota of AI requests per day

Rate limits are enforced automatically. If you exceed your quota, you will receive an error message and may need to wait for the quota to reset or upgrade your subscription.

7.4 Data Collection and Logging

When you use AI features, we collect and log:

  • Your user ID and email address
  • Content you send to AI services (prompts, text, PDFs, URLs, search queries)
  • AI responses and generated content
  • Usage metadata (timestamps, models used, token counts)
  • Subscription tier and request counts for rate limiting

This data is processed through Cloudflare's infrastructure and used for service operation, rate limiting, cost tracking, and troubleshooting. See our Privacy Policy for details.

7.5 Your Responsibilities

You are solely responsible for:

  • Content you submit to AI features
  • Ensuring you have rights to submit content (no copyrighted materials without permission, no personal data of others without consent)
  • Compliance with applicable laws and regulations
  • Not using AI features for illegal, harmful, or abusive purposes
  • Monitoring your usage and staying within your subscription tier limits

7.6 Third-Party AI Service Providers

AI features are powered by third-party providers (OpenAI, Anthropic). While we manage the infrastructure and API credentials, the underlying AI models and services are provided by these third parties. You acknowledge that:

  • Your content is transmitted to third-party AI providers through our infrastructure
  • AI providers have their own terms of service and privacy policies
  • We have limited control over AI provider operations, availability, or policies
  • AI providers may change their services, models, or pricing

Third-party terms:

7.7 No Warranty on AI Features

We make no warranties, representations, or guarantees regarding:

  • The availability, reliability, or performance of AI features
  • The quality, accuracy, appropriateness, or safety of AI-generated content
  • Compliance of AI services with applicable laws or regulations
  • Continued availability of specific AI models or features
  • Uninterrupted service or freedom from errors

AI-generated content should be reviewed and verified before use. We are not responsible for errors, inaccuracies, or inappropriate content generated by AI.

7.8 Service Changes and Availability

We reserve the right to:

  • Modify subscription tiers and rate limits at any time
  • Change AI models or providers without notice
  • Temporarily suspend AI features for maintenance
  • Discontinue AI features with reasonable notice
  • Adjust pricing for paid tiers with advance notice

7.9 Limitation of Liability for AI Features

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY DAMAGES, LOSSES, OR COSTS ARISING FROM:

  • Use of AI features or AI-generated content
  • Inaccurate, inappropriate, offensive, or harmful AI-generated content
  • Service interruptions, rate limiting, or unavailability
  • Changes to AI features, models, pricing, or availability
  • Third-party AI provider actions or policies
  • Data logging or collection as described in our Privacy Policy
  • Violations of third-party terms of service

9. iCloud Sync

The App uses Apple's iCloud service to sync your data across your Apple devices. By using iCloud sync features, you acknowledge and agree to the following:

9.1 Apple's Terms Apply

Use of iCloud is subject to Apple's iCloud Terms and Conditions and Apple's Privacy Policy:

iCloud is a service provided by Apple Inc., not by us. We have no control over iCloud's operation, availability, security practices, or data handling.

9.2 Your Responsibilities

You are responsible for:

  • Maintaining a valid iCloud account with sufficient storage capacity
  • Complying with Apple's iCloud Terms and Conditions
  • Managing your iCloud storage and ensuring sufficient space for app data
  • Securing your Apple ID and iCloud account credentials
  • Understanding Apple's data retention and deletion policies
  • Managing which devices have access to your iCloud data
  • Regularly backing up important data outside of iCloud if desired

9.3 No Access to Your iCloud Data

We do not operate any backend servers that store, access, or process your study data. All data synchronization occurs directly between your devices and Apple's iCloud infrastructure using CloudKit. We cannot:

  • View, access, or retrieve your iCloud data
  • Recover lost or deleted iCloud data
  • Assist with iCloud account or storage issues
  • Control what data is synced or when synchronization occurs
  • Restore data if you delete it from iCloud

For any iCloud-related issues, you must contact Apple Support directly.

9.4 Data Synchronization

Regarding data synchronization:

  • Synchronization timing and reliability are controlled by Apple's iCloud service
  • Network connectivity and iCloud service availability affect sync performance
  • Conflicts between devices are resolved automatically by CloudKit's conflict resolution
  • We cannot guarantee immediate or perfect synchronization
  • Sync may be delayed or fail due to network issues, iCloud outages, or insufficient storage

9.5 Data Loss Risks

You acknowledge that data loss may occur due to:

  • iCloud service outages or technical issues
  • Insufficient iCloud storage space
  • Accidental deletion by you on any synced device
  • Apple ID or iCloud account issues
  • Sync conflicts or data corruption
  • Changes to Apple's iCloud service or policies
  • Removal of the App from your devices

IMPORTANT: We strongly recommend regularly exporting your data as a backup. We are not responsible for any data loss, regardless of cause.

9.6 iCloud Storage and Costs

iCloud storage is provided by Apple and may incur costs based on your iCloud storage plan:

  • Apple provides limited free iCloud storage; additional storage requires a paid iCloud+ subscription
  • You are responsible for all iCloud storage costs
  • If you exceed your iCloud storage limit, synchronization may fail
  • We have no control over Apple's pricing or storage policies

9.7 Security and Privacy

Regarding iCloud security:

  • Data is encrypted in transit and at rest by Apple
  • Security depends on Apple's implementation and your Apple ID security
  • We do not control Apple's encryption methods or security practices
  • You are responsible for enabling two-factor authentication and securing your Apple ID
  • Anyone with access to your Apple ID can access your synced data

9.8 Limitation of Liability for iCloud

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY DAMAGES, LOSSES, OR COSTS ARISING FROM:

  • iCloud service outages, failures, or unavailability
  • Data loss, corruption, or synchronization failures
  • Unauthorized access to your iCloud account
  • Insufficient iCloud storage space
  • Changes to Apple's iCloud service, features, or pricing
  • Conflicts or inconsistencies between devices
  • Apple's data handling, retention, or deletion practices
  • Termination or suspension of your iCloud account by Apple

10. User-Generated Content and Import Responsibility

You are solely responsible for all content you import into or create within the App, including but not limited to:

  • Anki packages (.apkg, .colpkg, .anki21b files) imported from third parties
  • Media files (images, audio, video) included in your study materials
  • Text content in flashcards, notes, and other materials
  • AI-generated content created using your API keys

You represent and warrant that you have all necessary rights, licenses, and permissions for content you import or create, and that such content does not violate any third-party intellectual property rights, privacy rights, or applicable laws. We do not monitor, review, or verify user content and are not responsible for any content you import or generate.

11. Intellectual Property

The App and its original content, features, and functionality are owned by Bluprintr, Inc. and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. The App incorporates various open-source libraries, which are subject to their respective licenses (see Open Source Licenses).

12. Privacy

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

13. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE FROM VIRUSES OR OTHER HARMFUL COMPONENTS.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL BLUPRINTR, INC. BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • Your use or inability to use the App
  • Any unauthorized access to or use of our servers and/or any personal information stored therein
  • Any interruption or cessation of transmission to or from the App
  • Any bugs, viruses, trojan horses, or the like that may be transmitted to or through the App
  • Any errors or omissions in any content or for any loss or damage incurred as a result of your use of any content posted, emailed, transmitted, or otherwise made available through the App
  • Third-party services including AI providers, iCloud, Auth0, and Cloudflare (covered in detail in Sections 7, 8, and 9 above)

15. Indemnification

You agree to indemnify, defend, and hold harmless Bluprintr, Inc., its parent, subsidiaries, affiliates, officers, directors, employees, agents, licensors, and service providers from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:

  • Your use of the App, AI features, or iCloud sync
  • Your violation of these Terms
  • Your violation of any third-party rights, including intellectual property rights or privacy rights
  • Content you import, create, or transmit through the App
  • Your use of AI services and any content you submit to them
  • Unauthorized use of your Auth0 account or iCloud account
  • Violations of third-party terms of service (Auth0, Apple, AI providers)

16. Updates and Modifications

We may update, modify, or discontinue the App at any time without notice. We may also modify these Terms from time to time. Continued use of the App after any such changes constitutes your acceptance of the new Terms. It is your responsibility to review these Terms periodically.

17. Termination

We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason, including breach of these Terms. Upon termination, your right to use the App will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including but not limited to ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

18. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. Any dispute arising from these Terms or your use of the App shall be subject to the exclusive jurisdiction of the federal or state courts located in the State of Delaware.

Before initiating any formal legal proceedings, you agree to first contact us to attempt to resolve any disputes informally.

19. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. The invalid or unenforceable provision shall be replaced with a valid, enforceable provision that most closely matches the intent of the original provision.

20. No Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. Any waiver of any provision of these Terms will be effective only if in writing and signed by us.

21. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Bluprintr, Inc. regarding the use of the App and supersede all prior agreements and understandings.
